According to the Code of Civil Procedure, this method is mandatory when there is an incapacitated heir or a will. It is also the option available when the heirs deem it necessary to litigate a certain claim.<\/p>\n<p class=\"brz-text-lg-justify brz-tp-paragraph brz-lh-lg-2 brz-lh-sm-im-2_1 brz-lh-xs-im-2_1 brz-css-ddEDr\"><\/p>\n<p class=\"brz-text-lg-justify brz-tp-paragraph brz-lh-lg-2 brz-lh-sm-im-2_1 brz-lh-xs-im-2_1 brz-css-hui5R\">As with out-of-court proceedings, they must be opened within 60 days of the date of death.
