What is the Unhealthy Work Bonus?

The unhealthy working conditions bonus is financial compensation for workers who work in conditions that are harmful to their health. It is provided for in article 192 of the CLT and is regulated by Regulatory Standard NR-15.

What is the value of this right?

The amount of the additional varies according to the degree of exposure to risk: 10% on the minimum wage (minimum degree), 20% (medium degree) or 40% (maximum degree). It is important to note that the calculation is made on the national minimum wage, not on the worker's salary.

Who is entitled to it?

The main situations that give rise to entitlement to the bonus include exposure to excessive noise (above 85 decibels), intense heat, mineral dust such as silica and asbestos, harmful chemicals, radiation, biological agents in hospitals and laboratories, extreme cold, excessive humidity, hydrocarbon oils and greases. 

How do I receive it?

In order to be entitled to the bonus, it is necessary to prove the unhealthiness through a technical expert report carried out by an occupational doctor or occupational safety engineer. The expert report must identify the harmful agents and classify the degree of unhealthiness.

If you work or have worked in conditions that could be considered unhealthy and have never received this additional pay, or if your employer refuses to pay it even if they can prove it unhealthy, It is advisable to seek specialized legal advice to guarantee your rights.
